Terms and Conditions

These terms govern your use of the Small Hero Holidays app and the tours booked through it. Small Hero Holidays Sdn Bhd (886399-H) is licensed by the Ministry of Tourism, Arts and Culture Malaysia under licence KPL 6698. 1. BOOKING AND CONFIRMATION Prices, departure dates and seat availability shown in the app are indicative. A booking exists only once our staff have confirmed it and the deposit has been received. Where a departure shows seats remaining, that figure is accurate at the moment you view it and may change before your booking is confirmed. A tour runs subject to its minimum group size, shown on each package. If that number is not reached we will tell you at least fourteen days before departure and offer you a transfer to another departure or a full refund of what you have paid us. 2. PRICES Prices are per person in Malaysian Ringgit, based on two people sharing a room. Travelling alone carries a single supplement, shown on the package. Prices include what is listed under inclusions on each package and exclude what is listed under exclusions. Tipping, travel insurance, visa fees, personal spending and optional excursions are excluded unless expressly stated. Airport taxes and fuel surcharges are those in force when the tour is priced. If an airline or authority changes them before departure we will pass on the difference, and you may cancel without penalty if the increase exceeds ten per cent of the tour price. 3. PAYMENT A deposit is payable on confirmation and the balance no later than thirty days before departure. We may release your seats if the balance is not received by then. 4. CHANGES AND CANCELLATION BY YOU Cancellation charges are calculated on the days remaining before departure and are set out in your booking confirmation. Airline tickets, visa fees and supplier deposits are frequently non-refundable once issued, and those amounts are payable regardless of when you cancel. Name changes and date transfers are subject to what the airline and the ground operator will allow, and to their charges. 5. CHANGES AND CANCELLATION BY US Itineraries are planned in advance and may change. Where weather, traffic, closures or the acts of a supplier make a listed sight or activity impossible, we will substitute something comparable where we can. Where we cannot, that element is not refundable if the change was outside our control. Flight timings shown are subject to change by the airline. If we cancel a departure for any reason other than your own act or default, you may transfer to another departure or take a full refund of what you have paid us. Beyond that we are not liable for costs you arranged separately, which is why we ask you to insure. 6. TRAVEL DOCUMENTS AND FITNESS TO TRAVEL You are responsible for holding a passport valid for at least six months beyond your return date, and for any visa or entry permit your nationality requires. We will tell you what is needed if you ask, but we cannot obtain them for you and we are not liable if you are refused entry. Tell us before booking about any medical condition, mobility limitation or dietary requirement. Some itineraries involve walking on uneven ground, at altitude, or in extreme cold. 7. INSURANCE Travel insurance is not included unless the package says so. We strongly recommend it, covering at least medical treatment, repatriation and cancellation. 8. CONDUCT Our tour leader may require a participant to leave the tour where their conduct endangers others or seriously disrupts the group. No refund is due in that case and onward costs are yours. 9. COMPLAINTS Tell the tour leader at the time, so the problem can be addressed while you are still there. If it cannot be resolved, write to us within thirty days of your return. 10. LIABILITY We arrange transport, accommodation and activities provided by others. We accept responsibility for selecting those suppliers with reasonable care. We are not liable for loss or injury caused by an event that neither we nor the supplier could have foreseen or avoided. Nothing here limits liability for death or personal injury caused by our negligence, or any other liability that cannot lawfully be limited. 11. GOVERNING LAW These terms are governed by the laws of Malaysia and subject to the exclusive jurisdiction of the Malaysian courts. 12.
